Please review these Terms of Service carefully as they are binding agreement between you ("Customer") and BayLink Voicemail Service ("BayLink"). If you do not agree with BayLink's Terms of Service or any changes to these Terms, it is the Customer's responsibility to cancel their service. The Terms of Service are subject to change from time to time. BayLink will provide you with written notice of any material updates at least thirty (30) days prior to the effective date, unless these updates are the result from changes in laws, regulations, or requirements from telecommunications providers.

Customer Verification
BayLink Voicemail Service conforms to telecommunications industry standard "Know Your Customer" (KYC) policies and procedures. This process is used to identify and verify a customer's identity and activity.
BayLink customers must provide name, address, email, cell phone and payment card information to order services.
BayLink Voicemail Service will validate the information provided through various methods including but limited to email, phone call and/or web search.
BayLink may require that the person/organization/entity requesting services provide documentation that matches the provided customer information. This may include but is not limited to a government issued ID such as a driver's license, proof of address such as a utility bill, business EIN.
Customer Conduct
BayLink has the right to refuse service to anyone who uses the services provided hereunder for obscenities, illegal activities, harassment or who interferes with or harasses BayLink or its customers. BayLink services are not to be used for high volume promotions, commonly referred to as robo calling.
Fair Use Policy
All BayLink Services are provided on a flat rate fee basis. However, if a customer's usage exceeds by two (2) times, the average level of voice, fax, call transfer or SMS usage of the average level of usage of all other BayLink customers, BayLink, at its sole discretion, may change the fees charged for these services.
Phone Number Ownership
BayLink will provide a phone number to a customer solely for the purposes of enabling services that have been ordered. Customers understand and agree that they do not own the phone number provided by BayLink.
If a customer wishes to port-in a phone number from another service provider, the customer maintains ownership of that number, but its availability will be governed by the same operational procedures as any other BayLink number. These procedures are outlined below.
In the event that customer fails to pay their invoice in a timely manner, services will be disabled. Services can be re-activated with the same phone number if payment including any re-activation and late fees are received within 30 days of the service cancellation. If no payment is received within 30 days of service cancellation, the phone number will be returned to BayLink' s carrier with no guarantee of future availability.
In the event that customer wishes to move (port out) a BayLink phone number to another service provider, BayLink will, upon customer's written request (email), allow the number to be moved based on the following conditions:
the customer service with that number is active and customer has no outstanding invoice payments
the number has not been used to provide services to another BayLink customer
In the event that a customer moves (port out) a phone number before the end of the current prepayment period, no refund will be provided.
Service Guarantee
BayLink service guarantee is limited to the operation and availability of equipment that BayLink owns and operates. BayLink's service guarantee does not extend to outages over which we have no control such as Acts of Nature (weather), power outages, labor disputes or service interruptions by telecommunications carriers that BayLink may or may not use. In the event of a Service Interruption lasting more than 1 hour, BayLink will use all reasonable, commercial means to communicate the status of our service to all customers.
Liability Limitations
Information provided by BayLink on this web site (www.baylinkvoicemail.com), User Guides, our emails, invoices and text messages are for informational purposes only. BayLink does not warrant the fitness of this information for any particular purpose. BayLink will not be liable to any party for any direct, indirect or consequential damages related to use of our web site and services.
Payments and Refunds
All BayLink services are provided on a prepaid basis.
Customers will be invoiced by email approximately 20 days prior to the end of the current prepayment period. The grace period for late payments is 5 calendar days.
If no payment is received by end of the grace period, services will be disabled and subject to re-activation and late payment fees.
In the event that a customer wishes to cancel service before the end of the prepayment period, refund will be cancelled using the following method. Payment amount received minus total of the monthly rate for services cancelled multiplied by the number of months of service used.
